Terms and Conditions.

These Terms & Conditions (“Terms”) apply to all services provided by Kanuka Studio Limited (“Kanuka Studio”, “we”, “our”, or “us”). By accepting a quote, engaging our services, or using our website, you agree to these Terms.

1. Ownership of Assets

  • All 3D models, textures, materials, render settings, and related assets used in creating CGI renders (“Assets”) remain the property of Kanuka Studio Limited.

  • Assets are not transferred to the client unless expressly agreed in writing.

2. Client Usage Rights

  • Upon full payment, the client is granted a non-exclusive license to use the final rendered images (“Renders”) for the specified project.

  • Permitted use includes marketing, presentations, and promotional materials.

  • Modifying, redistributing, or reselling the Renders or Assets without prior written approval is prohibited.

3. Intellectual Property of Client Brands

  • Logos, trademarks, and products of clients shown in renders are the property of the respective brands and are used solely for illustrative purposes.

  • Clients must ensure they have the right to provide any such materials to Kanuka Studio.

4. Portfolio Use

  • Kanuka Studio may showcase Renders, Assets, and related work for promotional and portfolio purposes, provided that any associated information is no longer confidential and has entered the public domain, unless the Client notifies Kanuka Studio in writing to the contrary.

5. Payment Terms

  • Fees are due according to the agreed schedule in the quote or invoice.

  • Late payments may incur additional charges.

6. Project Timeline & Client Responsibilities

  • Project start and completion dates are estimates and may depend on timely feedback and approvals from the client.

  • Clients are responsible for providing accurate information, materials, and approvals needed for the project. Delays may affect the timeline.

  • This quote includes a specified number of revisions. Additional revisions may incur extra fees.

7. Limitation of Liability

  • Kanuka Studio Limited is not liable for indirect, incidental, or consequential damages arising from the use of deliverables.

  • Our total liability for any claim is limited to the fees paid for the specific service in question.

8. Termination of Project

  • Either party may terminate the project with written notice.

  • Payment is required for any work completed up to the termination date.

9. Privacy & Confidentiality

  • We respect client confidentiality. Any sensitive information shared with us will be used solely for the purpose of delivering services, unless disclosure is required by law.

  • Handling of personal information is governed by our Privacy Policy.

10. Governing Law

  • These Terms are governed by the laws of New Zealand.

  • Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
